Millions Turn to AI for Retirement Planning as Liability Gap Widens

ChatGPT gets retirement math wrong 35% of the time, yet 47% of Americans now seek its financial advice—while regulators confirm AI-generated recommendations may escape fiduciary duties that bind human advisers.

Artificial intelligence chatbots have become the unregulated advisers to America’s retirement system, handling calculations that determine whether millions will have enough money to last their lifetimes—even as the tools hallucinate answers more than a third of the time and no clear legal framework assigns responsibility when the advice fails.

In a 2024 Experian survey, 47% said they’ve turned to an AI chatbot for financial advice, while a July 2024 Ipsos poll found 37% of Americans are already using AI to manage their finances, including 61% of Gen Z. The trend marks a fundamental restructuring of how retirement decisions are made: only 9% of boomers say they’re likely to use an AI financial adviser, compared to 20% among Gen Z, according to a Yahoo Finance/Ipsos survey. But the tools they’re consulting produce unreliable output at alarming rates.

The Accuracy Crisis

These ‘hallucinations,’ in which LLMs convincingly make up false content, have become a well-known feature of LLM output, according to research published in Harvard Data Science Review. LLM-generated inaccuracies, misconceptions, and hallucinations could lead to significant negative consequences for an individual’s life savings or an institution’s pension fund. The study documented ChatGPT fabricating academic citations, attributing a 1987 paper to authors who never wrote it.

“ChatGPT lacks one crucial step needed in financial planning: KYC,” or know your client, according to financial advisers who reviewed its output for AARP. “More worrisome is the chatbot’s susceptibility to hallucinations. That is a scary thing to be planning your future around.”

The Fiduciary Void

The regulatory architecture offers no clear answer to the central question: who is responsible when AI pension advice destroys a retiree’s financial security? “If the services provided by your lawyer, doctor, or financial advisor suddenly start coming directly from a software product, where does the duty to act in your personal best interest go?” according to analysis by law firm Zwillgen. “We are facing a future where our trusted advisors may be more consistent and accurate than ever, yet be completely dissociated from any direct human obligation to act in our best interest.”

The use of technology itself doesn’t satisfy an advisor’s fiduciary obligations, according to SEC guidance. “A reasonable person wouldn’t consider ‘the software said so’ to be by itself a good case for making a prudent financial decision, so advisors can’t use that line of reasoning.” Yet when consumers input their retirement data directly into ChatGPT—bypassing advisers entirely—those protections vanish.

Context

Investment advisers, as fiduciaries, are subject to a duty of care to provide investment advice in the best interest of their clients, according to Morrison Foerster. AI advisors aren’t held to the same standard as fiduciary financial advisors and, as of now, can’t be held liable for the advice they provide. This creates a two-tier system: human advisers face SEC enforcement for bad recommendations, while AI tools generating identical advice face none.

AI cannot fulfill fiduciary duties without human oversight, and “AI models, no matter how advanced, are unlikely to be able to replace the human judgment, accountability, or discretion required to fulfill fiduciary obligations,” according to legal analysis by Cullen and Dykman LLP.

The $30 Trillion Question

The stakes extend far beyond individual retirees. The global robo advisory market was valued at $6.61 billion in 2023 and is projected to reach $41.83 billion by 2030, according to Grand View Research. In 2022, robo-advisers managed more than $2.4 trillion in invested assets worldwide, still a fraction of total assets under management, which will top $120 trillion, according to data compiled by AARP.

But AI is now moving beyond traditional robo-advisers—which follow programmed algorithms—into generative territory. 73% of employees are already using AI for guidance on personal health, finance, and wellness, with many uploading employer benefit documents into open systems, according to research released by Nayya in November 2025. Many of these consumer tools surface inaccurate information and are not designed to securely handle sensitive plan details.

Regulatory Inertia

The SEC’s 2026 examination priorities mark AI as a focus area, yet stop short of establishing liability standards. The Division will evaluate whether firms’ actual AI usage matches their representations to clients, but “the Division’s integration of AI into multiple priority categories signals that AI oversight will be a component of virtually all examinations going forward,” according to analysis by Goodwin.

ESMA has stated that financial institutions “must take full responsibility for the actions of AI systems they deploy,” eliminating ambiguity about liability in Europe, according to a report by Venable LLP. The U.S. has adopted no equivalent standard. The legal duties that apply to advice do not change just because AI is in the loop, as investment advisers owe a fiduciary duty to act in the client’s best interest under the Investment Advisers Act of 1940—but that framework assumes a human adviser is in the chain.

The SEC has pursued “AI-washing” cases—bringing enforcement actions against investment advisers for misleading investors about the extent to which they use AI, according to Ropes & Gray—but those cases address marketing misrepresentations, not the reliability of AI-generated financial recommendations themselves.

What to Watch

Three pressure points will determine whether AI in retirement planning becomes a democratizing force or a systemic risk. First, courts will soon face the question of who bears damages when a retiree follows AI advice into insolvency—the chatbot developer, the user, or no one. The first known case of an investor suing an AI developer over autonomous trading reportedly occurred in 2019, according to Congressional Research Service analysis, but no precedent exists for retirement planning.

Second, the robo-advisory industry is consolidating rapidly. In March 2022, Goldman Sachs acquired NextCapital, a robo-adviser specializing in workplace pensions that advises retirement plans and supplies its underlying technology to other financial institutions under a “white label”, as reported by Allied Market Research. Until liability follows the advice—regardless of whether it originates from an algorithm or a human—the cost of AI hallucinations will be paid by retirees who trusted the technology with their life savings.
